Air Canada filed an
application with the Federal Court
of Canada today concerning its
proposed merger with Canadian
Airlines. Air Canada is seeking
a declaration that the Onex-American Airlines
bid to take-over the company will
not be exempted from merger review
under the Competition Act.
Air Canada says Onex and
American Airlines acknowledge that
their bid requires anti-trust
clearance in the United States and
Europe. But the Onex bid suggests
that the proposed merger of Air
Canada with Canadian Airlines
does not require approval under
Canada’s Competition Act. The bid
only refers to the Canada
Transportation Act.
