The Ontario District Council of the Investment Dealers Association of Canada has imposed discipline penalties on Marie-Claude Filman.
On Nov. 14, 2002, the IDA accepted a settlement agreement in which Filman admitted that she failed, in her capacity as a branch manager at the North York office of Berkshire Securities Inc., to properly supervise a registered representative. Furthermore, she solicited participation in an off-book distribution without the knowledge or consent of her employer.
Filman was fined $25,000 and is required to pay $3,000 for investigation costs. She is also prohibited from acting in any supervisory capacity with any IDA member-firm for a period of five years. As a condition of re-approval by the IDA in any registered capacity she must successfully re-write the examination based on the Conduct and Practices Handbook for Securities Industry Professionals.
