The IDA’s board of directors has amended its by-laws to beef up its ability to collect evidence in an investigation. The changes require firms to ensure that their employees comply with a by-law that demands their co-operation in an investigation. The rule change also requires all parties to produce for inspection and provide documents that the Association determines may be relevant to a matter under examination or investigation. The existing by-law requires the production of documents relevant to matters being investigated.
The IDA says the amendments will serve to improve the effectiveness of IDA enforcement investigations by ensuring that evidence can be compiled from all relevant persons and that documents necessary for disciplinary action are collected without undue delays and disputes. The change is effective immediately.
