A broker who has already won one wrongful dismissal suit intends to sue another former employer in a British Columbia court.

Cenk Albayrak, a former broker, is suing Merrill Lynch & Co. Canada Ltd. Albayrak claims that Merrill reneged on a 1999 agreement in which the firm agreed to purchase his client accounts. The suit also claims Merrill breached a contract in which one of its brokers agreed to hire Albayrak as a marketing assistant.

Albayrak was last registered in B.C. on June 30, 1999 — when he left Merrill. He had joined Merrill’s predecessor, Midland Walwyn Capital, after leaving Nesbitt Burns in 1996.

Last summer, Albayrak won in a $350,000 wrongful dismissal suit against Nesbitt. This decision set a precedent in recognizing the broker’s proprietary interest in client accounts. In the present case with Merrill, Albayrak is seeking unspecified damages for breach of contract.
