A former broker has been granted leave to appeal a decision by the B.C. Securities Commission, which granted the Canadian Venture Exchange jurisdiction over him in a long-running disciplinary case.
From 1993 through 2000, Harjit Gill, was employed as a registered representative with various member firms of the Vancouver Stock Exchange. In 1997, the VSE alleged that he had breached certain of its rules and bylaws. In 1999, the VSE merged with the Alberta Stock Exchange to create the CDNX. When CDNX scheduled a hearing on the allegations against him, Gill applied to the BCSC for a determination of whether CDNX had jurisdiction to enforce the rules and bylaws of the VSE. The commission decided on April 26, that the CDNX did indeed inherit the VSE’s jurisdiction.
Gill turned to the courts seeking leave to appeal the decision of the commission, and for a stay of proceedings until the appeal is heard. The judge granted both the leave and the stay.
