A former hospital clerk is facing quasi-criminal charges from securities regulators in connection with allegations that she misappropriated the personal information of maternity patients at her hospital and sold the information to scholarship plan salesmen.

The Ontario Securities Commission (OSC) announced Monday that Shaida Bandali of Pickering, Ont. has been charged with unregistered trading in connection with the alleged misappropriation and misuse of confidential patient information at Rouge Valley Hospital. The allegations have not been proven.

The OSC alleges that between January 1, 2010 and March 31, 2014, Bandali repeatedly breached the confidentiality policies of her employer by accessing, copying, or distributing confidential personal data of maternity patients to reps selling Registered Education Savings Plans (RESPs). It alleges that she created potential investor lists from unauthorized access to confidential maternity patient information; and sold those lists to RESP dealer reps. In doing so, it alleges that she traded in securities without being registered.

Bandali’s first court appearance is set for Dec. 12, at the Old City Hall, Ontario Court of Justice in Toronto.

The OSC reports that the charges follow an investigation carried out by its Joint Serious Offences Team (JSOT), which is an enforcement partnership between the OSC, the RCMP Financial Crime program and the OPP Anti-Rackets Branch; and, that the investigation “is ongoing and continues on a priority basis.”
